FCC Aqualia S.A. (hereinafter “Aqualia” or “the Organiser”), with Tax Identification Number (CIF) A26019992 and registered office at C/ Federico Salmón 13, Madrid 28016, hereby organises a digital Contest (hereinafter, the “Contest”), which shall be governed in accordance with these legal terms and conditions (hereinafter, the “Terms”).
The Contest organised by Aqualia consists of participants submitting photographs via the website www.aqualiayoungcontest.com (hereinafter, the “Platform”), where children will be able to upload images showing different biodiversity environments. These photographs will subsequently be assessed by a jury in order to determine the winners in the various categories, provided that they comply with these Terms.
Photographs in which minors’ faces are visible will not be published.
All photographs must reflect real-life situations; images generated using AI or similar tools will not be accepted.
The Contest will be open to all submissions uploaded to the Platform from 00:00 (GMT+1) on 22 May 2026 (World Biodiversity Day) until 00:00 (GMT+1) on 25 September 2026 (the 11th Anniversary of the SDGs). Entries submitted outside this period will not be accepted. Should it become necessary, due to force majeure or circumstances beyond Aqualia’s control, to postpone, modify, cancel or repeat the Contest, participants will be informed of such changes via the Platform or by email.
The Contest is open to the following participants:
Children, grandchildren and nieces/nephews of Aqualia employees aged between 5 and 16 years.
Entries from individuals who do not meet these requirements will not be considered valid.
Participation in this Contest implies full acceptance of these Terms and express submission to the interpretative decisions of the Organiser. Aqualia reserves the right to disqualify any participant who fails to comply with these Terms, particularly where entries contravene them.
By accepting these Terms, participants acknowledge and agree to the provisions herein and undertake to comply with all applicable regulations. Participation in the Contest constitutes full and irrevocable consent to these Terms and to applicable law.
Any express objection by a participant, regardless of when it is made, shall result in their automatic withdrawal from the Contest and release Aqualia from any obligations undertaken with that participant.

In order to participate, the participant must be registered by their parent, grandparent, aunt or uncle, who must be an Aqualia employee, by completing the registration form (PARTICIPATE button).
The photograph must be uploaded through the same form and should reflect the child’s personal perspective on nature and biodiversity.
The Platform will request participant details as well as the email address of their parent, guardian or relative in order to obtain the necessary authorisation for the child’s participation and for the publication of images. Once validated and authorised, photographs will be published in the Photo Gallery section of the Platform, where they may be voted on by clicking the heart icon displayed on each image.
The jury will determine the winners based on creativity, originality and alignment with the Contest theme. The jury’s decision shall be final and binding.
Aqualia reserves the right not to award prizes to any participant who attempts to manipulate or disrupt the proper functioning of the Contest.

Prizes are non-transferable and may not be exchanged or altered at the request of the winners. Prizes will be delivered within the period determined by the Organiser.
In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter, the “GDPR”), and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, the “LOPDGDD”), Aqualia informs you that the personal data of the child or minor under guardianship, as well as those of the parent, legal guardian and, where applicable, aunt, uncle or grandparent completing the registration, collected as part of the Contest registration process, are collected solely for the purpose of obtaining the legally required consent for minors under the age of fourteen via the Platform https://www.aqualiayoungcontest.com/
Furthermore, you are informed that, as the parent or legal guardian of the participating minor, the personal data collected through the Platform, as well as any data generated during the course of the Competition, will be processed for the purpose of managing their participation, in accordance with the acceptance of these Terms.
Any additional processing of the minor’s personal data, in particular the publication or dissemination of their image, voice or any other personal data through media channels (websites, social media, etc.), shall require the prior, explicit and separate consent of the parent or legal guardian, which must be given freely and independently from the acceptance of these Terms.
The purposes of the processing are as follows:
For the proper conduct of the Contest, it is necessary that the personal data of participants collected via the Platform, as well as those provided for prize delivery, are accurate, complete and up to date. By accepting these Terms, participants undertake to ensure this. Should the personal data of a winner be inaccurate, false, incomplete or not kept up to date in such a way that identification is not reasonably possible, Aqualia reserves the right to disqualify them, with no liability arising therefrom.

The purpose of processing the personal data provided by you as parent, guardian, and, where applicable, aunt, uncle or grandparent, and of the minor, is to enable registration, the running of the Contest and, where appropriate, its promotion.
The legal basis for processing the personal data provided is the organisation and execution of the Contest, as well as the consent you have given as parent or legal guardian for the minor to participate and, where applicable, for the use of their image and voice as described.
Your personal data will be retained for the duration of the Contest and its promotion, or until you request their deletion. Once promotional activities have ended, your data will be stored in a restricted form for the legally required limitation periods and subsequently deleted.
Your data will not be disclosed to any third party unless required by law.

By accepting the consent clause for dissemination, the legal representatives of participants who are declared winners grant Aqualia exclusive rights, with the ability to assign such rights to third parties, to use their image in connection with their participation in the Contest. Such images may be publicly communicated via various media (websites, social media, etc.)
For these purposes, the participant’s legal representative authorises Aqualia to use the participant’s image, voice (where consent has been given) and personal data collected during the Contest, for exploitation in any format, worldwide and for as long as necessary to fulfil the stated purposes.
Furthermore, where a participant submits a video including the image of a third party, the participant is responsible for informing that third party and obtaining their express consent for the processing of their image by Aqualia under the conditions and purposes described above. Aqualia may request proof of such consent at any time.
Participants guarantee that they are the sole holders of the intellectual property rights to the content submitted and accept full responsibility for ensuring that no third-party rights are infringed, including any claims relating to image rights and/or intellectual property.
Participants grant Aqualia the rights to use, reproduce and disseminate the photographs through, without limitation, media, exhibitions, advertising campaigns, social media, websites, etc. These rights are granted without any territorial or time limitation.
Furthermore, the photographs selected by Aqualia to form part of the composition and design of the following year’s Aqualia corporate calendar and given that at Aqualia we believe in and promote an ethical, responsible, and transparent use of artificial intelligence, may be professionally processed using graphic design and AI tools for illustrative purposes and to add value to the overall design.
Aqualia reserves the right to cancel any entry or disqualify any participant where there are reasonable grounds to suspect improper manipulation of data or of the Contest.
The Organiser reserves the right to reject or exclude any participant who does not meet the requirements set out in these Terms or who breaches the rules or purpose of the Contest.
The Organiser accepts no liability for malfunction of the Platform or for any loss of data caused by email or internet failures.
Furthermore, the Organiser shall not be liable for any damages of any kind that may arise, despite the security measures adopted, from improper use of the services or content by users, including, but not limited to, damages arising from identity impersonation by a user in any communication made through the Platform.
If any provision of these Terms is declared wholly or partially invalid or unenforceable, such invalidity shall affect only that provision or the relevant part, and the remainder of the Terms shall remain in full force and effect, unless the affected provision is essential to the Terms as a whole.
These Terms shall be governed by and construed in accordance with Spanish law. For any disputes arising from the existence, access to, use or content of these Terms, both the participant and Aqualia expressly waive any other jurisdiction to which they may be entitled and submit to the exclusive jurisdiction of the Courts and Tribunals of Madrid.
